1. The Service

Blenz ("we", "us", "our") operates Oscar ("App", "Service") — a contact management and productivity application that enables users to capture, organise, and manage professional contact information. Oscar is currently available on Android. iOS availability may follow.

These Terms constitute a legally binding agreement between you ("you", "User") and Blenz. These Terms are governed by and interpreted in accordance with the laws of India.

2. Eligibility

You must be at least 18 years of age to use Oscar without parental consent. Users between 13 and 18 years of age may use the App only with verifiable parental or guardian consent, as required under the Digital Personal Data Protection Act, 2023.

Oscar is intended for personal and professional use. By using the App, you represent that you meet the age requirement and have the legal capacity to agree to these Terms.

3. Account Registration

You may sign in using Google Sign-In or a mobile phone number. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to:

• Provide accurate information at registration
• Keep your login credentials confidential
• Notify us promptly if you suspect unauthorised access

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Free and Pro Plans

Oscar offers a Free tier and a paid Pro subscription. Current plan features:

Plan features may change. Material changes will be communicated via in-app notice or email with reasonable advance notice.

5. Subscriptions and Payments

5.1 Pricing

Prices are inclusive of applicable taxes unless otherwise stated. We reserve the right to revise pricing with 30 days' notice.

5.2 Free Trial

New Pro subscribers receive a 7-day free trial. No charge is applied during the trial. If you do not cancel before the trial ends, your payment method will be charged. You may cancel at any time during the trial at no cost.

5.3 Billing and Renewal

Subscriptions are billed in advance on a monthly or annual cycle and auto-renew at the end of each period unless cancelled before the renewal date.

5.4 Cancellation

You may cancel at any time via Settings → Subscription → Manage Subscription. Cancellation takes effect at the end of the current billing period. Pro access continues until then.

5.5 Refund Policy

We do not offer refunds for partial subscription periods. For billing errors or disputed charges, contact us at connect@blenz.in within 7 days of the charge. Refund decisions are made at our discretion.

For App Store purchases (iOS, when available), Apple's refund policy applies. For Google Play purchases, Google's refund policy applies. Please refer to their respective policies for details.

5.6 Restore Purchases

If you reinstall the App or change devices, use "Restore Purchases" in the app to recover your active subscription.

6. Scan Credits and Monthly Quota

Monthly scan credits reset on the 1st of each calendar month. Unused credits do not roll over. Free users who exhaust their monthly quota may be offered a one-time emergency credit at our discretion — this is a courtesy, not a contractual entitlement.

7. User Content and Responsibility

You retain ownership of the contact data you create and store in Oscar. By using the App, you grant Blenz a limited, non-exclusive licence to process and store your data solely to provide the Service.

You are responsible for ensuring you have appropriate consent or a lawful basis to capture and store the contact information of individuals whose business cards you scan. You agree to use Oscar only for lawful purposes and in compliance with applicable privacy laws, including India's DPDPA 2023.

8. Contact Sharing and Attribution

When you share a contact using Oscar's sharing features, the contact information will be sent to the recipient in the format you select. Shared contacts may include an attribution note referencing Oscar. This is a condition of using the sharing feature and cannot be disabled.

You are responsible for obtaining the consent of the individuals whose contact details you share with others.

9. Referral Programme

Oscar's referral programme lets you invite others to the App using a personal referral code. Rewards are:

• Referred user upgrades to Pro → referrer receives 1 month of Pro access
• Referred user remains on Free → referrer receives a quota bonus added to the following month

Rewards have no cash value and cannot be transferred or exchanged. We reserve the right to modify or terminate the referral programme at any time.

10. Prohibited Uses

You agree not to use Oscar to:

• Capture or store contact information without appropriate consent
• Circumvent usage quotas or plan limitations through technical means
• Reverse engineer, decompile, or disassemble the App
• Use the App for spam, unsolicited mass communications, or harassment
• Violate any applicable law, regulation, or third-party rights
• Create accounts for purposes of abuse, fraud, or competitive intelligence

Violation may result in immediate account suspension or termination without notice or refund.

11. Intellectual Property

Oscar, including its design, branding, features, and software, is the intellectual property of Blenz. Nothing in these Terms grants you any right to use our name, trademarks, or branding without prior written consent.

Third-party services used within Oscar (including but not limited to Google services, payment processing services, and cloud infrastructure) are governed by the terms and licences of their respective owners.

12. Disclaimer of Warranties

Oscar is provided "as is" and "as available". We do not warrant that the App will be error-free, uninterrupted, or that all contact data will be extracted or processed with complete accuracy. OCR and AI-assisted correction results depend on card quality, lighting conditions, and font legibility — always review extracted data before relying on it.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Blenz's total liability to you for any claim arising from your use of Oscar shall not exceed the total amount you paid to us in the three months preceding the claim.

We shall not be liable for indirect, consequential, incidental, or punitive damages — including loss of contacts, loss of business, or data loss — arising from your use of or inability to use the App.

14. Indemnification

You agree to indemnify and hold Blenz harmless from any claims, losses, or expenses (including legal fees) arising from your violation of these Terms, misuse of the App, or infringement of any third-party rights.

15. Modifications to the Service

We may modify, suspend, or discontinue Oscar or any of its features at any time with reasonable notice. We are not liable to you for any such modification, suspension, or discontinuation.

16. Termination

You may delete your account at any time via Settings → Account → Delete Account. This permanently removes all your data within 30 days and cannot be undone.

We may suspend or terminate your account without notice for violation of these Terms, suspected fraud, or conduct harmful to other users or the Service.

17. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of India.

We encourage disputes to be raised with us directly first — most issues can be resolved quickly by contacting connect@blenz.in.

18. Apple App Store (when applicable)

When Oscar becomes available on the Apple App Store:

• These Terms apply in addition to Apple's App Store Terms of Service
• Apple is not a party to these Terms and has no obligation to provide support for Oscar
• In the event of any conflict between these Terms and Apple's terms, Apple's terms shall take precedence with respect to your use of the App Store
• You agree to comply with applicable third-party terms when using Oscar in connection with Apple services

19. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via in-app notice or email before they take effect. Your continued use of Oscar after the effective date constitutes acceptance of the updated Terms.
